"Мәдениет туралы" Қазақстан Республикасының Заңының 7-бабы 35-15) тармақшасына және "Қазақстан Республикасы Мәдениет және ақпарат министрлігінің кейбір мәселелері туралы" Қазақстан Республикасы Үкіметінің 2023 жылғы 4 қазандағы № 866 қауылысымен бекітілген Қазақстан Республикасының Мәдениет және ақпарат министрлiгi туралы Ережесінің 15-тармағының 333) тармақшасына сәйкес, БҰЙЫРАМЫН:

1. Осы бұйрыққа 1-қосымшаға сәйкес Ұлттық мәдени игiлiк объектiлерiнiң мемлекеттiк тiзiлiмiн қалыптастыру және жүргізу қағидалары бекітілсін.

2. Осы бұйрыққа 2-қосымшаға сәйкес кейбір бұйрықтардың күші жойылды деп танылсын.

3. Қазақстан Республикасы Мәдениет және ақпарат министрлігінің Мәдениет комитеті Қазақстан Республикасының заңнамада белгіленген тәртіппен:

1) осы бұйрықты Қазақстан Республикасының Әділет министрлігінде мемлекеттік тіркеуді;

2) осы бұйрықты Қазақстан Республикасы Мәдениет және ақпарат министрлігінің интернет-ресурсында орналастыруды;

3) осы бұйрық Қазақстан Республикасының Әділет министрлігінде мемлекеттік тіркелгеннен кейін он жұмыс күні ішінде осы тармақтың 1) және 2) тармақшаларында көзделген іс-шаралардың орындалуы туралы мәліметтерді Қазақстан Республикасы Мәдениет және ақпарат министрлігінің Заң департаментіне ұсынуды қамтамасыз етсін.

4. Осы бұйрықтың орындалуын бақылау жетекшілік ететін Қазақстан Республикасының Мәдениет және ақпарат вице-министріне жүктелсін.

5. Осы бұйрық алғашқы ресми жарияланған күнінен кейін күнтізбелік он күн өткен соң қолданысқа енгізіледі.

1-тарау. Жалпы ережелер

1. Осы Ұлттық мәдени игілік объектілерінің мемлекеттік тізілімін қалыптастыру және жүргізу жүргізу қағидалары (бұдан әрі – Қағидалар) "Мәдениет туралы" Қазақстан Республикасының Заңының 7-бабы 35-15) тармақшасына және "Қазақстан Республикасы Мәдениет және ақпарат министрлігінің кейбір мәселелері туралы" Қазақстан Республикасы Үкіметінің 2023 жылғы 4 қазандағы № 866 қауылысымен бекітілген Қазақстан Республикасының Мәдениет және ақпарат министрлiгi туралы Ережесінің 15-тармағының 333) тармақшасына сәйкес Ұлттық мәдени игілік объектілерінің мемлекеттік тізілімін (бұдан әрі – Мемлекеттік тізілім) қалыптастыру және жүргізу тәртібін анықтайды.

2. Мемлекеттік тізілім ұлттық мәдени игілік объектілерін (бұдан әрі – ҰМИО) сақтау және оларға ерекше мән беру мақсатында жүргізіледі.

3. Мемлекеттік тізілімге ел тарихы мен мәдениеті үшін ерекше мәні бар ҰМИО туралы мәліметтер (бұдан әрі – ҰМИО туралы мәліметтер) енгізіледі.

2-тарау. Ұлттық тізбені қалыптастыру және жүргізу тәртібі

4. Мемлекеттік тізілімді мәдениет саласындағы уәкілетті орган (бұдан әрі – Уәкілетті орган) осы Қағидаларға қосымшаға сәйкес нысан бойынша қазақ және орыс тілдерінде, қағаз және электрондық жеткізгіштерде жүргізеді.

5. Мемлекеттік тізілімге осы Қағидаларға қосымшаға сәйкес нысан бойынша мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғалардан келіп түскен ҰМИО туралы мәліметтер енгізіледі.

6. Мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғалар жаңа объектілер мен ҰМИО заттарының анықталуына қарай қажетті мәліметтері бар ақпаратты уәкілетті органға береді.

7. Мемлекеттік тізілімді қалыптастыру үшін уәкілетті орган өтінімдерді қабылдау басталғанға дейін кемінде күнтізбелік 30 (отыз) күн бұрын өзінің Интернет-ресурсында тиісті ақпаратты жариялайды.

8. Мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғалар беретін ҰМИО туралы мәліметтер:

1) ҰМИО-ның толық атауын;

2) ҰМИО-ның сипаттамасын;

3) ҰМИО-ның жасалған күнін;

4) ҰМИО деректерін;

5) ҰМИО-ның шыққан жерін;

6) ҰМИО-ның орналасқан жерін;

7) ҰМИО-ның фотосуретін қамтиды.

9. ҰМИО туралы мәліметтерді уәкілетті орган келіп түскен күнінен бастап күнтізбелік 30 (отыз) күннің ішінде қарайды.

10. Мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғалардан осы Қағидалардың 8-тармағында көрсетілген ҰМИО туралы құжаттар топтамасы не (немесе) мәліметтер толық келіп түспеген жағдайда, уәкілетті орган талаптарға сәйкессіздікті анықтаған кезден бастап 1 (бір) жұмыс күні ішінде оны одан әрі қараудан уәжді бас тартуды дайындайды.

Мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғалар бас тарту туралы ақпаратты алған күннен бастап 3 (үш) жұмыс күні ішінде талаптарға сәйкес келетін құжаттарды уәкілетті органға қайта жолдайды.

11. Осы Қағидалардың 8-тармағында көрсетілген талаптарға сәйкес келген жағдайда, уәкілетті орган талаптарға сәйкестігін айқындаған кезден бастап 1 (бір) жұмыс күні ішінде ҰМИО туралы құжаттар топтамасын не (немесе) мәліметтерді ұсынымдар алу үшін уәкілетті орган жанынан құрылған тұрақты жұмыс істейтін Мәдениет мәселелері жөніндегі комиссияның мүшелеріне (бұдан әрі – Комиссия) жібереді.

12. Комиссия ҰМИО-де ел тарихы мен мәдениеті үшін ерекше мәнінің болуы немесе болмауы туралы ұсынымдық сипатта шешімдер қабылдайды, оны хаттамамен ресімдейді.

13. Комиссия хаттамасының негізінде уәкілетті орган осы Қағидалардың 9-тармағында көрсетілген мерзім iшiнде мынадай шешімдердің бірін қабылдайды:

1) ҰМИО туралы мәліметтерді Мемлекеттік тізілімге енгізу;

2) ҰМИО туралы мәліметтер ел тарихы және мәдениеті үшін ерекше мәні болмағандықтан, Мемлекеттік тізілімге енгізуге жатпайды.

14. Уәкілетті орган шешім қабылданған күннен бастап он жұмыс күні ішінде мәдени құндылықтарды зерделеумен айналысатын жеке және заңды тұлғаларға қабылданған шешім туралы хабарлайды.

Pursuant to subparagraph 35-15) of Article 7 of the Law of the Republic of Kazakhstan On Culture and subparagraph 333) of paragraph 15 of the Regulation on the Ministry of Culture and Information of the Republic of Kazakhstan, approved by the Resolution of the Government of the Republic of Kazakhstan dated October 4, 2023 № 866 “On Certain Issues of the Ministry of Culture and Information of the Republic of Kazakhstan”, I hereby ORDER:

1. Approve the attached Rules for the formation and maintenance of the State register of National Cultural Heritage Sites, in accordance with Appendix 1 to this order.

2. Invalidate certain orders in accordance with Appendix 2 to this order.

3. In the manner prescribed by the legislation of the Republic of Kazakhstan the Culture Committee of the Ministry of Culture and Information of the Republic of Kazakhstan shall ensure:

1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Culture and Information of the Republic of Kazakhstan;

3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, report to the Legal Department of the Ministry of Culture and Information of the Republic of Kazakhstan on the execution of the actions provided for in subparagraphs 1) and 2) of this paragraph.

4. Control over the execution of this order shall be assigned to the supervising vice-minister of culture and information of the Republic of Kazakhstan.

5. This order shall come into effect ten calendar days after the date of its first official publication.

Rules for the formation and maintenance of the State register of the National cultural heritage sites

Chapter 1. General provisions

1. These Rules for the formation and maintenance of the State Register of National Cultural Heritage Sites (hereinafter The Rules) have been developed in pursuance of subparagraph 35-15) of Article 7 of the Law of the Republic of Kazakhstan On Culture and subparagraph 333) of paragraph 15 of the Regulation on the Ministry of Culture and Information of the Republic of Kazakhstan, approved by the Resolution of the Government of the Republic of Kazakhstan dated October 4, 2023 № 866 “On Certain Issues of the Ministry of Culture and Information of the Republic of Kazakhstan” and establish the procedure for the formation and maintenance of the State Register of National Cultural Heritage Sites (hereinafter The State Register).

2. The State Register is maintained for the purpose of preserving the national cultural heritage sites (hereinafter referred to as NCHS) and giving them special significance.

3. The State Register shall contain information on NCHS that is of special significance for the history and culture of the country (hereinafter information on NCHS).

Chapter 2. Procedure for the formation and maintenance of the State Register

4. The State Register shall be maintained by the authorized body in the field of culture (hereinafter referred to as the authorized body) in the Kazakh and Russian languages, on paper and electronic media according to the form of the appendix to these Rules.

5. Information on the NCHS received from individuals and legal entities engaged in the study of cultural values shall be entered into the State Register according to the form of the appendix to these Rules.

6. As new objects and items of the NCHS are identified by individuals and legal entities engaged in the study of cultural values, information with the necessary details shall be provided to the authorized body.

7. In order to form the State Register, the authorized body, at least 30 (thirty) calendar days before the start of accepting applications, shall publish the relevant information on its Internet resource.

8. Information on the NCHS provided by individuals and legal entities engaged in the study of cultural values shall include:

1) full name of the NCHS;

2) description of the NCHS

3) date of creation of the NCHS;

4) NCHS data;

5) NCHS origin;

6) NCHS location;

7) NCHS photograph.

9. Information about NCHS shall be reviewed by the authorized body within 30 (thirty) calendar days from the date of its receipt.

10. In the event of an incomplete package of documents and (or) information about the NCHS specified in paragraph 8 of these Rules from individuals and legal entities engaged in the study of cultural values, the authorized body, within 1 (one) business day from the moment of determining non-compliance with the requirements, shall prepare a reasoned refusal to further consider the information.

Individuals and legal entities engaged in the study of cultural values, within 3 (three) business days from the date of receiving information about the refusal, shall re-submit documents that meet the requirements to the authorized body.

11. In case of compliance with the requirements specified in paragraph 8 of these Rules, the authorized body, within 1 (one) business day from the moment of determining compliance with the requirements, shall send a package of documents and (or) information about the NCHS to members of the permanent commission on cultural issues (hereinafter referred to as the Commission), created under the authorized body, for recommendations.

12. The commission shall make a recommendatory decision on the presence or absence of special significance of the NCHS for the history and culture of the country, formalized in the minutes.

13. Based on the minutes of the Commission, the authorized body shall, within the period specified in paragraph 9 of these Rules, take one of the following decisions:

1) to enter information about the NCHS into the State Register;

2) the information on the NCHS is not subject to inclusion in the State Register, as it is not of special significance for the history and culture of the country.

14. The authorized body shall notify individuals and legal entities engaged in the study of cultural values about the adopted decision within ten working days from the date of the decision.
