Pursuant to subparagraph 35-15) of Article 7 of the Law of the Republic of Kazakhstan On Culture and subparagraph 333) of paragraph 15 of the Regulation on the Ministry of Culture and Information of the Republic of Kazakhstan, approved by the Resolution of the Government of the Republic of Kazakhstan dated October 4, 2023 № 866 “On Certain Issues of the Ministry of Culture and Information of the Republic of Kazakhstan”, I hereby ORDER:

1. Approve the attached Rules for the formation and maintenance of the State register of National Cultural Heritage Sites, in accordance with Appendix 1 to this order.

2. Invalidate certain orders in accordance with Appendix 2 to this order.

3. In the manner prescribed by the legislation of the Republic of Kazakhstan the Culture Committee of the Ministry of Culture and Information of the Republic of Kazakhstan shall ensure:

1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) posting of this order on the Internet resource of the Ministry of Culture and Information of the Republic of Kazakhstan;

3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, report to the Legal Department of the Ministry of Culture and Information of the Republic of Kazakhstan on the execution of the actions provided for in subparagraphs 1) and 2) of this paragraph.

4. Control over the execution of this order shall be assigned to the supervising vice-minister of culture and information of the Republic of Kazakhstan.

5. This order shall come into effect ten calendar days after the date of its first official publication.

Rules for the formation and maintenance of the State register of the National cultural heritage sites

Chapter 1. General provisions

1. These Rules for the formation and maintenance of the State Register of National Cultural Heritage Sites (hereinafter The Rules) have been developed in pursuance of subparagraph 35-15) of Article 7 of the Law of the Republic of Kazakhstan On Culture and subparagraph 333) of paragraph 15 of the Regulation on the Ministry of Culture and Information of the Republic of Kazakhstan, approved by the Resolution of the Government of the Republic of Kazakhstan dated October 4, 2023 № 866 “On Certain Issues of the Ministry of Culture and Information of the Republic of Kazakhstan” and establish the procedure for the formation and maintenance of the State Register of National Cultural Heritage Sites (hereinafter The State Register).

2. The State Register is maintained for the purpose of preserving the national cultural heritage sites (hereinafter referred to as NCHS) and giving them special significance.

3. The State Register shall contain information on NCHS that is of special significance for the history and culture of the country (hereinafter information on NCHS).

Chapter 2. Procedure for the formation and maintenance of the State Register

4. The State Register shall be maintained by the authorized body in the field of culture (hereinafter referred to as the authorized body) in the Kazakh and Russian languages, on paper and electronic media according to the form of the appendix to these Rules.

5. Information on the NCHS received from individuals and legal entities engaged in the study of cultural values shall be entered into the State Register according to the form of the appendix to these Rules.

6. As new objects and items of the NCHS are identified by individuals and legal entities engaged in the study of cultural values, information with the necessary details shall be provided to the authorized body.

7. In order to form the State Register, the authorized body, at least 30 (thirty) calendar days before the start of accepting applications, shall publish the relevant information on its Internet resource.

8. Information on the NCHS provided by individuals and legal entities engaged in the study of cultural values shall include:

1) full name of the NCHS;

2) description of the NCHS

3) date of creation of the NCHS;

4) NCHS data;

5) NCHS origin;

6) NCHS location;

7) NCHS photograph.

9. Information about NCHS shall be reviewed by the authorized body within 30 (thirty) calendar days from the date of its receipt.

10. In the event of an incomplete package of documents and (or) information about the NCHS specified in paragraph 8 of these Rules from individuals and legal entities engaged in the study of cultural values, the authorized body, within 1 (one) business day from the moment of determining non-compliance with the requirements, shall prepare a reasoned refusal to further consider the information.

Individuals and legal entities engaged in the study of cultural values, within 3 (three) business days from the date of receiving information about the refusal, shall re-submit documents that meet the requirements to the authorized body.

11. In case of compliance with the requirements specified in paragraph 8 of these Rules, the authorized body, within 1 (one) business day from the moment of determining compliance with the requirements, shall send a package of documents and (or) information about the NCHS to members of the permanent commission on cultural issues (hereinafter referred to as the Commission), created under the authorized body, for recommendations.

12. The commission shall make a recommendatory decision on the presence or absence of special significance of the NCHS for the history and culture of the country, formalized in the minutes.

13. Based on the minutes of the Commission, the authorized body shall, within the period specified in paragraph 9 of these Rules, take one of the following decisions:

1) to enter information about the NCHS into the State Register;

2) the information on the NCHS is not subject to inclusion in the State Register, as it is not of special significance for the history and culture of the country.

14. The authorized body shall notify individuals and legal entities engaged in the study of cultural values about the adopted decision within ten working days from the date of the decision.

Приказ и.о. Министра культуры и информации Республики Казахстан от 4 апреля 2025 года № 141-НҚ. Зарегистрирован в Министерстве юстиции Республики Казахстан 7 апреля 2025 года № 35952.

В соответствии с подпунктом 35-15) статьи 7 Закона Республики Казахстан "О культуре" и подпунктом 333) пункта 15 Положения о Министерстве культуры и информации Республики Казахстан, утвержденного постановлением Правительства Республики Казахстан от 4 октября 2023 года № 866 "О некоторых вопросах Министерства культуры и информации Республики Казахстан", ПРИКАЗЫВАЮ:

1. Утвердить прилагаемые Правила формирования и ведения Государственного реестра объектов национального культурного достояния, согласно приложению 1 к настоящему приказу.

2. Признать утратившими силу некоторые приказы согласно приложению 2 к настоящему приказу.

3. Комитету культуры Министерства культуры и информации Республики Казахстан в установленном законодательством Республики Казахстан порядке обеспечить:

1) государственную регистрацию настоящего приказа в Министерстве юстиции Республики Казахстан;

2) размещение настоящего приказа на интернет-ресурсе Министерства культуры и информации Республики Казахстан;

3) в течение десяти рабочих дней после государственной регистрации настоящего приказа в Министерстве юстиции Республики Казахстан представление в Юридический департамент Министерства культуры и информации Республики Казахстан сведений об исполнении мероприятий, предусмотренных подпунктами 1) и 2) настоящего пункта.

4. Контроль за исполнением настоящего приказа возложить на курирующего вице-министра культуры и информации Республики Казахстан.

5. Настоящий приказ вводится в действие по истечении десяти календарных дней после дня его первого официального опубликования.

Правила формирования и ведения Государственного реестра объектов национального культурного достояния

Глава 1. Общие положения

1. Настоящие Правила формирования и ведения Государственного реестра объектов национального культурного достояния (далее – Правила) разработаны в соответствии с подпунктом 35-15) статьи 7 Закона Республики Казахстан "О культуре" и подпунктом 333) пункта 15 Положения о Министерстве культуры и информации Республики Казахстан, утвержденного постановлением Правительства Республики Казахстан от 4 октября 2023 года № 866 "О некоторых вопросах Министерства культуры и информации Республики Казахстан" и определяют порядок формирования и ведения Государственного реестра объектов национального культурного достояния (далее – Государственный реестр).

2. Государственный реестр ведется с целью сохранения объектов национального культурного достояния (далее – ОНКД) и придания им особого значения.

3. В Государственный реестр вносятся сведения об ОНКД, имеющих особое значение для истории и культуры страны (далее – сведения об ОНКД).

Глава 2. Порядок формирования и ведения Государственного реестра

4. Государственный реестр ведется уполномоченным органом в области культуры (далее – уполномоченный орган) на казахском и русском языках, на бумажном и электронном носителях по форме, согласно приложению к настоящим Правилам.

5. В Государственный реестр вносятся сведения об ОНКД, поступивших от физических и юридических лиц, занимающиеся изучением культурных ценностей, по форме, согласно приложению к настоящим Правилам.

6. По мере выявления новых объектов и предметов ОНКД физическими и юридическими лицами, занимающимися изучением культурных ценностей, в уполномоченный орган предоставляется информация с необходимыми сведениями.

7. Для формирования Государственного реестра уполномоченный орган не менее чем за 30 (тридцать) календарных дней до начала приема заявок публикует соответствующую информацию на своем Интернет-ресурсе.

8. Сведения об ОНКД, предоставляемые физическими и юридическими лицами, занимающимися изучением культурных ценностей включают:

1) полное наименование ОНКД;

2) описание ОНКД;

3) дата создания ОНКД;

4) данные ОНКД;

5) происхождение ОНКД;

6) местонахождение ОНКД;

7) фотография ОНКД.

9. Сведения об ОНКД рассматриваются уполномоченным органом в течение 30 (тридцати) календарных дней со дня их поступления.

10. В случае предоставления неполного пакета документов и (или) сведений об ОНКД, указанных в пункте 8 настоящих Правил, от физических и юридических лиц, занимающихся изучением культурных ценностей, уполномоченный орган в течение 1 (одного) рабочего дня с момента определения несоответствия требованиям готовит мотивированный отказ в дальнейшем рассмотрении cведений.

Физические и юридические лица, занимающиеся изучением культурных ценностей, в течение 3 (трех) рабочих дней со дня получения информации об отказе, повторно направляют в уполномоченный орган документы, соответствующие требованиям.

11. При соответствии требованиям, указанным в пункте 8 настоящих Правил, уполномоченный орган в течение 1 (одного) рабочего дня с момента определения соответствия требованиям, направляет пакет документов и (или) сведений об ОНКД, членам постоянно действующей комиссии по вопросам культуры (далее – Комиссия), созданной при уполномоченном органе, для получения рекомендаций.

12. Комиссия принимает решение рекомендательного характера о наличии или об отсутствии у ОНКД особого значения для истории и культуры страны, которое оформляется протоколом.

13. На основании протокола Комиссии уполномоченный орган в течение срока, указанного в пункте 9 настоящих Правил, принимает одно из следующих решений:

1) внести в Государственный реестр сведения об ОНКД;

2) сведения об ОНКД не подлежат внесению в Государственный реестр, так как не имеют особого значения для истории и культуры страны.

14. О принятом решении уполномоченный орган извещает физических и юридических лиц, занимающихся изучением культурных ценностей, в течение десяти рабочих дней со дня принятия решения.
